Resignation and termination of contracts

As a principle, both parties to an employment contract may terminate the employment agreement at any time, subject to either the statutory or contractual notice period, without the need to fulfil any statutory grounds for termination. The employer issuing the termination must, however, provide a written explanation of the termination upon the employee’s request.

Danish labour market practice requires that an employee who is dismissed receive a notice letter stating the dismissal terms. At a starting point, the employee cannot reject the fact that he/she is being dismissed, and no unions or public authorities can prevent the dismissal from being carried out.

  • If you want to resign, your notice to your employer is one month to the end of a month.
  • If you resign before the end of the 1 month probationary period, you have to give notice, typically 14 days.
  • If your employment is terminated by your employer, your employer’s notice periode is one month.
  • If your employer terminate you before the end of the 1 month probationary period, your notice periode is typically 14 days

Reason for job termination.

  • It is not permitted to terminate employment for reasons such as pregnancy, adoption or demands for equal pay. The employer must be able to document that the termination is not caused by any such reasons, but due to financial reasons or difficulties by the conduct of the employee, e.g. lack of performance or cooperation problems.
  • A dismissal justified by your conduct may, for instance, be because you have not performed satisfactorily, you do not keep your agreements, there are cooperation problems or because of sickness.
  • Dismissal justified by some sort of dissatisfaction with you as an employee will generally require that you have received a warning and have thus had an opportunity to improve. However, this does not apply in case of illness.

What is the dismissal procedure when my employer is dissatisfied with my performance?

  • If your employer is dissatisfied with your performance or a specific conduct, he or she can give you an admonition or a warning about the areas that need improvement.

What must a warning contain?

A warning must be clear and specific:

  • It must clearly state the issues that give rise to criticism and where improvement is required
  • The changes must be objective and measurable
  • It must state how the problems are expected to be solved
  • Follow-up meetings should be agreed where this makes sense
  • The warning should be in writing and must state that failure to comply with the requirements stated may have employment law consequences
  • A time frame may be give
